Landlords have less than six months to ensure their properties meet the minimum E rating in their energy performance certificates, without which they cannot let the property to new tenants. A civil penalty of up to £4,000 will be imposed on breaches of the rules. From 1st April 2018 landlords of private rental properties may not grant a tenancy to a new, or indeed an existing, tenant, if the property has an EPC rating of band F or G.
Of course, certain exemptions may apply, for example where the necessary works are not allowed under conservation rules or deemed uneconomic. Such properties would need improvements, as can reasonably be done, and must have third-party evidence supporting the claim which is entered into a publicly available exemptions register.
